- General rules
1.1 This Privacy Policy describes how BT Noma, SIA, registration number 40103589281, Riga, Martas iela 9 – 1, LV-1011 (hereinafter referred to as the “Data Controller”) collects, processes and stores personal data collected from its customers and individuals who visit the Website (hereinafter also referred to as the “Data Subject” or “You”).
1.2 Personal Data means any information about an identified or identifiable natural person, i.e. the Data Subject. Processing is any activity that involves personal data, such as obtaining, recording, organizing, using, consulting, altering, erasing or destroying it.
1.3 The controller of your personal data is BT Noma, SIA or another company within the BT Noma, SIA group to which you apply to purchase a product or receive a service.
1.4 The Data Controller shall comply with the applicable data processing principles and ensure that personal data are processed in accordance with applicable law.

- Collection, processing and storage of personal data
2.1 The Data Controller collects, processes and stores personally identifiable information primarily through the Website, by visiting the Shop and by email.
2.2 By visiting and using the services offered on the Website, you agree that the information provided is used and managed in accordance with the purposes set out in this Privacy Policy.
2.3 The data subject is responsible for ensuring that the personal data are correct, accurate and complete. Providing known false information is considered a violation of our Privacy Policy. The Data Subject is obliged to inform the Data Controller immediately of any changes to the Personal Data.
2.4 The Data Controller shall not be liable for any loss suffered by the Data Subject or third parties due to falsified personal data.

3.2 In addition to the foregoing, the Data Controller has the right to verify the information provided using publicly available registers.
3.3 The legal basis for the processing of personal data is Article 6(1)(a), (b), (c) and (f) of the General Data Protection Regulation of the European Union:
(a) the Data Subject has consented to the processing of personal data for one or more specified purposes;
(b) the processing is necessary for the performance of a contract to which the Data Subject is a party or for pre-contractual activities carried out at the request of the Data Subject;
(c) the processing is necessary for compliance with a legal obligation to which the Data Controller is subject;
(f) The processing is necessary for the legitimate interests of the Data Controller or of a third party, except where those interests are overridden by the interests or fundamental rights and freedoms of the Data Subject which require the protection of personal data, in particular where the Data Subject is a child.
3.4 The Data Controller shall store and process the Data Subject’s personal data until at least one of the criteria listed below is met:
- Personal data is necessary for the purposes for which it was collected;
- As long as the Data Controller and/or the Data Subject can exercise their legitimate interests in accordance with external rules, for example by lodging an objection or defending rights in court;
- As long as there is a legal obligation to retain the data, for example under the Accountancy Act;
- For as long as the Data Subject’s consent to the processing of personal data is valid, unless there is another lawful guideline for the processing of personal data.
- When the conditions listed in this paragraph no longer exist, the Data Subject’s personal data retention period shall end and all relevant personal data shall be permanently erased from computer systems and electronic and/or paper documents containing the relevant personal data or anonymised.
3.5 In order to fulfil its obligations towards you, the Data Controller has the right to transfer your personal data to its partners, data processors who carry out the necessary data processing on our behalf, such as accounting specialists, courier service providers, etc.
The Data Processor is the Data Controller.
Payment processing is provided by the payment platform makecommerce.lv, therefore our company provides the necessary personal data to the owner of the platform Maksekeskus AS for payment processing.
We may disclose your personal data to government and law enforcement agencies upon request to protect our legal interests in bringing and defending legal claims.
3.6 When processing and storing personal data, the Data Controller shall implement organisational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure or other unlawful processing.
4. Data subject rights
4.1 In accordance with the General Data Protection Regulation and the laws of the Republic of Latvia, you have the right to:
- Access to your personal data, information about its processing, the right to request a copy of your personal data in electronic format and the right to request the transfer of that data to another data controller (data portability);
- Request rectification of inaccurate, incorrect or incomplete personal data;
- Erasure of your personal data, except where required by law;
- To withdraw your prior consent to the processing of personal data;
- Request to restrict the processing of your personal data;
